Client Portal Terms

Your law firm uses BetterDocket to show you where your case stands, tell you what you need to do next, exchange messages, and collect documents. These terms cover your use of that portal. We have kept them short and in plain language.

Product Advantage LLC, a Delaware limited liability company doing business as BetterDocket ("BetterDocket," "we," "us"), operates this portal.

We are not your lawyer

We are a software company, not a law firm. We do not give legal advice, we do not represent you, and using this portal does not make us your lawyer.

Nothing you read in the portal is legal advice from us. Case stages, next steps, dates, and updates are written or chosen by your law firm. Some text in the portal is drafted with software assistance, but a person at your firm reviews it before you see it.

If you have a question about your case, message your law firm. Do not contact us about it — we cannot answer it, and we will refer you back to your firm.

Your law firm controls your information

Your firm decides what goes in your portal, what you can see, and how long it is kept. We store and protect that information on your firm's instructions, not our own.

That means:

• To see, correct, or delete your case information, ask your law firm. If you ask us, we will refer you to the firm.
• If your firm removes your access, or your case ends, your access ends.
• Your firm — not us — is responsible for what it chooses to show you.

Using the portal

Please:

• Keep your password to yourself, and protect the devices you stay signed in on. The portal does not currently offer two-factor authentication.
• Use the email address your firm invited.
• Only upload documents you have the right to share.
• Tell your firm right away if you think someone else has used your account.

Please do not:

• try to reach another person's case or another firm's information;
• upload anything unlawful, or any software designed to cause harm;
• scan, test, or attack the portal;
• copy or extract information in bulk by automated means; or
• pretend to be someone you are not.

We may suspend access we reasonably believe is unsafe or improper, and we will tell your firm when we do.

Sensitive information

Please do not upload payment card numbers, or medical records held under HIPAA, unless your firm has specifically asked you to. BetterDocket is a general-purpose case-communication tool and is not built for those categories.

What we cannot promise

The portal is provided "as is" and "as available." It is an early-stage product. To the fullest extent the law allows, we make no warranties about it, and we do not promise that it will always be available, error-free, or secure, or that information in it will always be preserved or recoverable.

Do not rely on the portal as your only copy of anything. Keep your own copies of documents that matter to you.

Our security page honestly describes what protections we have today and what we do not yet offer. It is worth reading if you plan to upload something sensitive.

Limits on our responsibility

To the fullest extent the law allows, we are not responsible for indirect or consequential losses, lost profits, or lost data. Our total responsibility to you for anything relating to the portal will not exceed one hundred dollars ($100).

Nothing here limits any right you have that cannot be limited by law, and nothing here affects your relationship with your law firm or any claim you may have against it.

Agreeing to these terms

When you continue into the portal after seeing the notice, that is your agreement to these terms, and it counts as your electronic signature under the federal ESIGN Act and Florida's electronic transactions law. We record which version you accepted and when.

Disputes

These terms are governed by Florida law. Disputes are brought in the state or federal courts in Orange County, Florida.

Each party waives any right to a jury trial, and may bring claims only individually and not as part of a class or representative proceeding. This does not apply to any claim you may bring in small-claims court, and it does not affect your relationship with your law firm.

Changes and contact

We may update these terms. Every published version stays available at its own permanent address, and we will ask you to acknowledge again if a change materially affects you.
